Skincare Academy Refer & Earn — Terms and Conditions

1. About the Program

The Skincare Academy Refer & Earn program (the Program) allows graduates of Skincare Academy programs (Referrers) to earn AUD $500 for each Advanced Acne to g l o w® new student enrollment on a pay-in-full basis using their unique referral link or code:

Level 1: Advanced Acne to g l o w®: you earn $500 and the new student receives $100 off.

This is a private referral program, not an affiliate program. Participation is by application, reviewed personally by Hayley, and not every application is approved.

By joining, you agree to these Terms and Conditions. All prices listed are in AUD.

The Program is operated by Skincare Academy Pty Ltd (ABN 18 655 063 004), Mooloolaba, Queensland, Australia.

2. Eligibility

To participate you must:

have completed Advanced Acne to g l o w® (to refer Advanced Acne to g l o w®);
apply and be approved for the Program;
be at least 18 years of age; and
comply with all applicable laws in your country of residence.

Your application link is located inside your Circle student portal.

Every application is reviewed personally by Hayley, Founder of Skincare Academy Pty Ltd. Places are limited and not every application is approved. We keep the Program deliberately small to honour the professional standard of the education we provide and the skin professionals we support. We reserve the right to accept or decline any application at our discretion, without providing a reason.

3. Eligible Programs

Commission applies only to pay-in-full enrolments at the full evergreen price.

Acne Flashcard Program™ credit. The $249 Acne Flashcard Program™ pay-it-forward credit does not apply to any enrolment made through the Refer & Earn Program and cannot be combined with the referral discount. If the person you refer chooses to use their $249 credit instead, the enrolment is not eligible for referral commission.

We reserve the right to add or remove programs at any time. You will be notified of any changes by email.

4. How Commissions Work

You earn a fixed AUD $500, inclusive of GST, for each eligible course a referred student enrols in on a pay-in-full basis using your unique referral link or code.

Commission is payable once per course, per student. Commission is not payable on:

payment plan enrolments;
enrolments by current or past Skincare Academy students;;
enrolments by anyone who did not use your referral link or code;
self-referrals, including enrolments made using your own referral link or code;
enrolments made using an unauthorised discount or coupon code;
enrolments where the $249 Acne Flashcard Program™ pay-it-forward credit has been applied; or
enrolments made during a Skincare Academy live launch or promotion.

5. Your $100 Referral Code

You will receive a referral discount code through Shopify Collabs to share with skin professionals who want to learn to identify and treat the root causes of acne in their clinic. The code gives $100 off each eligible course: $100 off Advanced Acne to g l o w®.

The code applies only to pay-in-full enrolments. It cannot be used on payment plans, cannot be combined with any other offer or credit, and is not redeemable for cash.

The code is for sharing directly within your professional network and must not be posted to public discount or coupon websites.

6. How Referrals Are Tracked

An enrolment is credited to you when the student completes a pay-in-full purchase using your unique referral link or code. Attribution is tracked for 30 days from the student's first click on your link. Enrolments that cannot be traced to your link or code cannot be credited retrospectively.

7. When You Are Paid

Commission is released 30 days after the new student's enrolment date, once that period has passed without a refund request. Payments are made in AUD through Shopify Collabs.

Skincare Academy programs are subject to a strict no-refund policy. In the rare event a refund is issued, for example where required under the Australian Consumer Law, the associated commission will be cancelled. The same applies to any enrolment that is cancelled or charged back.

We reserve the right to withhold or reverse commission where we suspect fraud or a breach of these Terms.

8. How to Share Your Referral Link or Code

Refer & Earn is a private referral program, not an affiliate program.

Advanced Acne to g l o w® is a clinical certification, not impulse purchases. They have always sold the way clinical education sells: one practitioner telling another she trusts, "this is what changed how I treat acne." That conversation cannot be a broadcast. It only works one to one.

So we ask you to share it the way you would recommend a mentor.

Mass emails or broadcast lists
Dropping your link or code into Facebook groups or forums unprompted
Coupon or deal aggregation websites
Skincare Academy photography, logos, copy, course imagery, graphics or other brand assets in your own content

You also agree to:

represent Skincare Academy Pty Ltd and its programs honestly and accurately at all times;
use only your approved referral link or code;
make no false, misleading or exaggerated claims about outcomes, results or earning potential;
make no medical claims, and imply no clinical outcomes that fall outside your scope of practice;
never present yourself as an employee, staff member or official representative of Skincare Academy;
make no claims about program content, outcomes or certification that Skincare Academy has not published; and
create no website or social media account that could be confused with an official Skincare Academy channel.

Why we are strict about this

Two reasons.

First, Skincare Academy is an award-winning leader in acne education for the skin and beauty industry, and how it is spoken about is part of the standard it sets.

Second, cold traffic does not enrol in a clinical certification. Your referral converts because it comes from you, personally, to someone who already trusts your clinical judgement. Broadcasting it removes the only ingredient that makes it work, and your conversion rate goes with it.

9. Disclosure

You must disclose that you earn a commission whenever you share your referral link or code. This applies in every permitted channel: private messages, email, professional groups and in-person conversation.

Disclosure must be clear and sit close to the link or code. In conversation, simply say it.

Wording you are welcome to use:

"This is my referral link and I earn a commission if you enrol through it, at no extra cost to you. You'll also receive $100 off each course when you pay in full."

This is not only our rule. Undisclosed commercial relationships can be misleading under the Australian Consumer Law, which is why we are firm about it. Failure to disclose may result in removal from the Program.

10. Intellectual Property: Use of Our Brand

The Skincare Academy Pty Ltd brand name, logos, imagery, copy and program names, including Advanced Acne to g l o w®, remain our exclusive property.

You are granted a limited, non-exclusive, non-transferable and revocable licence to refer to our name and program names in plain text only, in the private channels permitted under Section 8, for the sole purpose of sharing your referral link or code.

This licence does not extend to our logos, photography, course imagery, graphics or written copy, which may not be reproduced in your own content.

This licence ends immediately if you leave or are removed from the Program. At that point your referral link and code are deactivated, and you must stop using our name and program names in connection with any referral.

11. Your Status

Participation in the Program does not create an employment, agency, partnership or joint venture relationship between you and Skincare Academy Pty Ltd. You participate as an independent party and have no authority to enter into commitments on our behalf.

You are solely responsible for your own tax obligations arising from commission earned, including declaring it as income and any GST liability if you are registered.

Commission is a fixed amount of AUD $500 per eligible course, inclusive of any GST. If you are registered for GST, the commission is GST-inclusive and should be invoiced as such. No additional amount is payable. We may request your ABN before processing payment.

12. Privacy

To administer the Program we collect and hold your name, contact details, business and clinic details, your ABN where provided, and records of the referrals made through your link or code. Payments are processed through Shopify Collabs, which handles your payment details under its own terms.

Your information is handled in accordance with our Privacy Policy (www.skincareacademy.com.au/privacy-policy).

When you share your link or code, you must respect the privacy of the person you are referring to. You must not add anyone to a mailing list without their consent, pass their personal information to us or anyone else without their knowledge, or use their details for any purpose beyond the referral itself. You are responsible for complying with the Privacy Act 1988 (Cth) and the Spam Act 2003 (Cth) in your own communications.

13. Limitation of Liability

To the maximum extent permitted by law:

we are not liable for any indirect, incidental or consequential loss arising from your participation in the Program, including loss of profits, business opportunity, goodwill or data;
our total liability to you, however arising, is limited to the total commission paid to you in the 12 months preceding the claim; and
we are not liable for referrals that are not tracked or credited due to technical failure, browser settings, ad blockers, expired attribution, or the failure of any third-party platform, including Shopify Collabs.

We do not guarantee any level of referrals, income or sales from participation in the Program.

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot be excluded under the Australian Consumer Law.

14. Ending Participation

Either party may end your participation in the Program at any time by written notice.

Where participation ends for any reason other than a breach of these Terms, commission on qualifying enrolments completed before that date will still be paid, once the 30-day hold has passed, in the next payment cycle.

We may remove any Referrer immediately, and without payment of outstanding commission, where they breach these Terms, engage in fraudulent activity, or act in a way that damages the Skincare Academy brand.

On ending participation, your referral link and code are deactivated and the licence granted in Section 10 ends immediately.

We may amend, suspend or close the Program at any time, with notice to active Referrers. Commission already earned on completed qualifying enrolments will not be affected.

15. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on our website.

If you do not accept the updated Terms, you may end your participation at any time before they take effect. Any commission already earned will still be paid in the normal way.

Continued participation after the changes take effect constitutes acceptance of the updated Terms.

Changes do not affect commission already earned on qualifying enrolments completed before the change takes effect. The date these Terms were last updated appears at the top of this document.

16. Governing Law

These Terms are governed by the laws of Queensland, Australia. You and Skincare Academy Pty Ltd submit to the exclusive jurisdiction of the courts of Queensland and any courts entitled to hear appeals from them.

If you participate from outside Australia, you are responsible for complying with the laws of your own country, and for any currency conversion costs, bank fees or taxes that apply to your commission.

17. General

If any part of these Terms is found to be invalid or unenforceable, that part is severed and the remaining Terms continue in full force.

Our failure to enforce any provision of these Terms is not a waiver of that provision, or of our right to enforce it later.

These Terms, together with our Privacy Policy, form the entire agreement between you and Skincare Academy Pty Ltd in relation to the Program, and replace any earlier discussion, representation or arrangement.

Notices to you will be sent to the email address on your Referrer application. Notices to us should be sent to info@skincareacademy.com.au.
